Simple terms, like the service.

Sunday is a subscription service that places scheduled weekly telephone calls to a family member you designate (the "Storyteller"), asks a question chosen from our library or by your family, records the Storyteller's spoken answer, and makes the recording, transcript, and summary available to family members you invite ("Listeners") through text/email notifications and a private web feed — a generational memory vault for your family. By creating an account, purchasing, redeeming a gift, or accepting a Listener invitation, you agree to these Terms.

You must be 18+ and able to form a binding contract to purchase or manage a plan. You're responsible for the accuracy of information you provide — especially the Storyteller's phone number — and for activity under your account. One person per family plan is the "Account Owner," with control over the Storyteller's schedule, questions, Listeners, and billing.

Sunday records telephone calls. State recording laws vary: some states require one party's consent; a number of states — commonly identified as including California, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon (as to certain communications), Pennsylvania, and Washington — require all parties' consent. Sunday's policy is to obtain all-party consent for every recorded call, in every state. Because Sunday is the party making the recording, Sunday captures the Storyteller's consent directly rather than relying on the Account Owner's assurances alone:

(a) Your consent. As Account Owner, you consent to Sunday recording calls with your designated Storyteller and processing recordings as described in §5.

(b) The Storyteller's consent — captured by Sunday, on the call. No recording begins until the Storyteller affirmatively consents. On the first call, before any recording starts, Sunday plays a clear notice that calls will be recorded so their family can keep their stories, and asks the Storyteller to confirm by voice or keypress. If they don't confirm, the call ends with nothing recorded and we notify you. Every later call opens with a brief recorded-call disclosure. The Storyteller may withdraw consent at any time — by saying so on a call, contacting us, or asking any family member to pause the service — and withdrawal stops all future recorded calls.

(c) Your representations (supplementary, not a substitute). By designating a Storyteller you confirm that: (i) you reasonably believe they will welcome the calls and you've told them (or asked us to send a heads-up) before the first call; (ii) to your knowledge they have the capacity to understand and consent to recording; (iii) the number you provide is theirs. If circumstances change (for example, a diagnosis affecting capacity), you agree to pause the service and contact us.

(d) Others on the line. Calls are intended one-on-one. Anyone who joins after the recorded-call disclosure consents by participating; if anyone objects, recording stops.

(e) No covert recording — ever. Sunday may not be used to record anyone without their knowledge and consent. Accounts attempting covert recording are terminated.

(a) Family Plan — $99/year, billed annually in advance; auto-renews until canceled. We send renewal reminders before each renewal as required by applicable auto-renewal laws. Cancel anytime in your account or via hello@sundayvoices.com; cancellation stops renewals and scheduled calls at the end of the paid term.

(b) Founding Rate — $79/year, first 200 families. Available only to the first 200 Family Plan subscriptions. The $79/year rate is locked for as long as the subscription remains continuously active; if the subscription is canceled or lapses, later re-subscription is at then-current pricing. The founding rate is a discounted price on the Family Plan and includes all Family Plan features; it is not a lifetime license.

(c) Give a Year of Sundays — $119 one-time gift. Never auto-renews. Includes a redemption code; the 52-week gifted term begins at redemption. Redemption codes do not expire. When a gifted year ends without the family choosing a paid plan, calls stop but the family's archive remains accessible and downloadable at no charge.

(d) The 30-day guarantee — measured from the first call. If Sunday isn't right for your family within 30 days of the Storyteller's first completed call, email us and we'll refund the payment in full — and your family keeps every recording made. (For gifts, the window runs from the first call after redemption.)

(e) Payments are processed by Stripe; we don't store full card numbers. Prices may change prospectively with notice and never mid-term. (Founding-rate subscribers: your rate doesn't change while continuously subscribed, per (b).)

The recordings, transcripts, and summaries belong to your family, not to us. As between you and Sunday, the Account Owner holds these rights for the benefit of the Storyteller and invited Listeners. You grant Sunday a limited, non-exclusive license to record, store, transcribe, summarize, transmit, and back up this content solely to provide and operate the service for your family. We do not sell your recordings, use them for advertising, or use them to train artificial-intelligence models. Automated processing (transcription, titles, summaries) uses service providers under confidentiality obligations. You may export your complete archive in standard formats at any time, including after cancellation — and you may request deletion of any recording or the entire archive at any time, which we will complete within 30 days (excepting minimal records we must retain by law, and consent-capture artifacts retained as legal evidence of lawful recording).

Listeners you invite can hear recordings, read transcripts, react, comment, and suggest questions. Only invited people have access; nothing is public. The share-a-clip feature lets a family member deliberately share an excerpt outside the family; whoever shares is responsible for having the family's (and Storyteller's) blessing. Don't invite Listeners the Storyteller would not want listening.

Tell us and we immediately stop all scheduled calls and will not send renewal or marketing messages referencing the Storyteller. The archive remains available to the Account Owner and Listeners as a permanent memorial archive at no ongoing charge, fully downloadable. Any unused portion of the current term is refunded on request.

Sunday is a storytelling and memory-keeping service. It is not a medical, safety-monitoring, emergency-response, or elder-care service. A completed, missed, or unusual call is not a health or safety signal, and you should not rely on Sunday to check on anyone's wellbeing. If you're concerned about a family member, contact them, their caregivers, or emergency services directly.

The service is for recording willing family storytellers only. You agree not to: record anyone without consent (§3e); place or cause unsolicited calls; harass, exploit, or defraud a Storyteller or family member; submit unlawful content as questions or comments; access other families' archives; resell the service; or interfere with its operation. We may suspend or terminate violating accounts, refunding unused prepaid amounts except in cases of serious misuse.

By providing your number and opting in, you consent to receive the service's transactional calls and texts (call notifications, summaries, account messages), including via automated systems. Frequency: roughly weekly per storyteller; message and data rates may apply; reply STOP to end texts, HELP for help. Listener consent is captured in the invitation flow containing this disclosure.

The Sunday name, site, question library, recorded prompt audio, and software are ours or our licensors'. You receive a personal, non-transferable license to use the service as intended. Feedback may be used without obligation.

Our Privacy policy is part of these Terms. Headline commitments: no sale of personal information, no advertising use of recordings, no AI-training use of recordings, family-only access, full export anytime, deletion on request.

The service is provided "as is." We don't guarantee every scheduled call connects or that transcripts and summaries are error-free. To the fullest extent permitted by law, our total liability for any claim is limited to the greater of amounts you paid us in the prior twelve months or $100; neither party is liable for indirect or consequential damages. Some states don't allow certain limitations, so parts of this section may not apply to you. Nothing limits liability that can't lawfully be limited.

We'd rather fix things than fight about them: email us first and we'll try to resolve any dispute informally. If we can't, these Terms are governed by the laws of the state of Sunday's incorporation, and disputes are resolved there.
